Terms of Service, Privacy Policy, Consent, Waiver, Code of Conduct, and Cancellation Agreement

VideoGame.Net
Effective Date: February 12, 2026

This is a legally binding agreement between VideoGame.Net (“Company”) and the parent or legal guardian (“Parent”) of a participating minor (“Participant”). By enrolling in any program, purchasing any digital product, subscribing to membership, scheduling tutoring, or completing checkout, you agree to all terms below.

1. Governing Law

This agreement shall be governed by and construed under the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. Any legal action not subject to arbitration shall be brought exclusively in a court located within Pennsylvania.

2. Binding Arbitration and Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to this agreement or participation in any VideoGame.Net program shall be resolved by binding arbitration in Pennsylvania. Arbitration shall be conducted by a single neutral arbitrator and administered in accordance with the rules of the American Arbitration Association. Each party shall bear its own legal fees unless otherwise required by law. The arbitrator may award only actual damages and shall not award punitive damages. By agreeing to arbitration, you waive the right to a jury trial. This clause does not prevent either party from seeking small claims relief where permitted by law.

3. Class Action Waiver

You agree that disputes will be resolved only on an individual basis. You waive any right to bring, join, or participate in any class, collective, representative, or private attorney general action against VideoGame.Net, and you waive any right to class-wide arbitration.

4. Scope of Services

VideoGame.Net provides educational programs and related services that may include live online instruction, in-person events, camps, after-school programs, tutoring, esports programming, memberships, digital downloads, self-paced courses, software licenses, and access to learning platforms.

5. Eligibility and Parental Authority

You represent that you are at least 18 years of age, you are the Participant’s legal parent or guardian, and you have authority to enter into this agreement on behalf of the Participant.

6. Privacy Policy and Data Protection

VideoGame.Net collects and processes personal information for enrollment, account creation, payment processing, program delivery, communication, and service improvement. Information collected may include Parent and Participant names, contact information, account credentials, participation data, and communications. Payment information is processed by third-party payment processors and is not stored by VideoGame.Net. Minor data is collected only with verified parental consent. Parents may request review or deletion of their child’s data, subject to legal and operational obligations. VideoGame.Net does not sell personal data.

7. Technology and Artificial Intelligence

Programs may involve game-based platforms, learning management systems, video conferencing, collaborative tools, and Artificial Intelligence systems, including conversational and generative tools. Parent consents to the Participant’s supervised use of required tools for educational purposes. VideoGame.Net does not control third-party content accessible via the internet.

Parent authorizes Participant to participate in VideoGame.Net services. Participation may involve physical, technical, and online interaction risks. Parent voluntarily assumes these risks. To the fullest extent permitted by Pennsylvania law, Parent releases and holds harmless VideoGame.Net and its owners, officers, employees, contractors, affiliates, and partners from claims arising from participation, except in cases of gross negligence or willful misconduct.

9. Media Release

Parent grants permission for VideoGame.Net to photograph, record, stream, or capture audio and video of the Participant during participation, and to use student-created work for instructional and promotional purposes. No personal identifying information will be publicly shared beyond ordinary program participation without additional consent.

10. Participant Code of Conduct

Participation is a privilege. Parent agrees to review these standards with the Participant before the program begins. If Participant engages in harmful, disruptive, unsafe, disrespectful, unethical, or unlawful conduct, VideoGame.Net may remove Participant immediately without refund or future credit.

  • Protect property: Destroying, deleting, defacing, stealing, or damaging digital files, game worlds, projects, equipment, devices, or materials is prohibited.
  • No piracy: Downloading, uploading, or sharing pirated, illegal, adult, or unethical software or media is prohibited.

11. Internet and Network Policy

VideoGame.Net does not control information available through the internet or third-party services. External sites may contain inaccurate, offensive, or inappropriate material. VideoGame.Net makes no warranties regarding third-party content or uninterrupted access and assumes no responsibility for content accessed outside official program materials, costs incurred due to misuse, or consequences of service interruptions or changes. Network and platform access is a privilege, not a right, and may be terminated for misuse without refund.

12. Payment Terms

All payments are processed through secure third-party payment processors. By completing checkout, you agree to pay all tuition, fees, and charges associated with your selected product or service.

D. Live Programs and Camps

Cancellations more than twenty one (21) days prior to the program start date may receive a credit toward a future program. No refunds are provided within twenty one (21) days of the start date. No refunds are provided for late arrival, early departure, or dismissal due to misconduct. If VideoGame.Net cancels a program, a refund or credit will be offered. Credits have no cash value.

14. Membership Terms

Membership subscriptions may include recurring billing. By subscribing, you authorize recurring charges until cancellation. Membership fees are non refundable once a billing period begins. To avoid renewal, you must cancel before the next billing date. Failure to cancel prior to renewal does not entitle you to a refund.

15. Technical Responsibility

Participants are responsible for maintaining adequate internet access, compatible devices, and required software. VideoGame.Net is not responsible for connectivity failures or platform outages outside its control.

16. Chargebacks

Parent agrees to contact VideoGame.Net before initiating any chargeback or payment dispute. Improper or unauthorized chargebacks may result in suspension or termination of services and collection action for unpaid balances.

17. Indemnification

Parent agrees to indemnify, defend, and hold harmless VideoGame.Net, its owners, employees, contractors, affiliates, and partners from any claims, damages, liabilities, costs, or expenses arising from Participant misconduct, violation of this agreement, unauthorized use of services, or third-party claims resulting from Participant actions.

18. Limitation of Liability

To the maximum extent permitted under Pennsylvania law, VideoGame.Net’s total liability shall not exceed the amount paid for the specific product or program in dispute. VideoGame.Net shall not be liable for indirect, incidental, consequential, or punitive damages.

19. Entire Agreement

This document constitutes the entire agreement between the parties and supersedes all prior understandings or representations.
